Canadians Eligible for Class action Settlement Money if they were prescribed these medicines

Purdue Pharma has agreed to a settlement to resolve claims related to the negligent release of OxyContin in Canadian markets. Several class action lawsuits were filed against Purdue Pharma. The lawsuits claimed that Purdue Pharma did not properly warn patients and doctors about how addictive and dangerous OxyContin and OxyNEO could be.

The company was also accused of misleading advertising that made these drugs seem safer than they were, which led many people to become addicted and suffer serious health problems.  Because of Purdue Pharma’s actions, many patients ended up getting addicted, overdosing, and facing other serious health issues.

The approved settlement establishes a $20,000,000 fund to compensate eligible class members who suffered injuries from using OxyContin and/or OxyNEO. This fund also covers various related costs, including reimbursement to provincial health insurers for healthcare expenses, claims administration costs, legal fees and disbursements, and applicable taxes.

The exact amount of compensation for each eligible Class Member will be determined based on a points system outlined in Exhibit “B” of the Settlement Agreement. Points are awarded by the Administrator after reviewing the Claim Form and supporting evidence. The final compensation amount for an individual Class Member will only be known once all claims are processed and the administration is completed.

Who is Eligible for the compensation?

The settlement applies to:

  1. All persons in Canada, including their estates, who were prescribed (in Canada) and ingested OxyContin and/or OxyNEO tablets between January 1, 1996, and February 28, 2017 (“Class Members”).
  2. Individuals in Canada who have a personal relationship with a Class Member and qualify to bring a claim for damages under the Ontario Family Law Act or equivalent legislation in other provinces or territories (“Family Class”).

To be eligible for compensation, a Class Member must:

  • Have consumed OxyContin and/or OxyNEO for the first time by prescription.
  • Have developed an addiction.
  • Have suffered one or more specified injuries as a result.

Required Documents

To qualify for compensation, Class Members must submit a Claim Form along with documentation proving:

  1. Prescription of OxyContin and/or OxyNEO during the relevant period.
  2. Development of an addiction following the prescription.
  3. Absence of pre-existing addiction and/or substance abuse problems prior to being prescribed OxyContin and/or OxyNEO.

Specific injuries that may entitle Class Members to higher compensation include:

  • Overdose.
  • Suicide attempts.
  • Participation in a treatment program.
  • Methadone use.
  • Loss of employment, professional license, child custody, and/or housing during the addiction period.

Deadline for Submitting Claims

The Claim Form and supporting documents must be received by the Administrator, RicePoint Administration Inc., no later than June 27, 2024. Claims submitted after this date will not be considered for compensation.

If a claim is rejected, Class Members have the right to appeal the Claims Administrator’s decision. Appeals must be submitted within 30 days from the date of the decision notice, along with a $100 fee.
