Thursday, Gabrielle Unionot filed a discrimination complaint against several parties involved in the America has talent.

According to the complaint filed with the California Department of Fair Employment and Housing (DFEH), Gabrielle suffered discrimination, harassment and retaliation while working as a judge during season 14 of the show in 2019 DFEH complaints are often precursors to prosecution.

By USA today, the complaint specifically calls NBC Universal Television, Fremantle Productions North America, judge and co-creator Simon Cowelland his company, Syco Entertainment.

“Union, a black woman, was singled out for her physical appearance and discriminated against by NBC because her hair did not match the white image that NBC had apparently sought to convey to the public from AGT“Said the complaint. The complaint filed Thursday follows it and Julianne Hough‘s out of the series last fall, after only one season as judges.

After their departure, reports surfaced that Gabrielle had made various complaints. The original Variety a report published in November cites several cases which have contributed to a “toxic” working environment. A special moment included the guest judge Jay Leno make a racist joke. Although the comedian did not respond to the journalist’s request for comment at the time, he said in December that he enjoyed working with Gabrielle and that she was a “big girl”.

Gabrielle and Julianne are also said to have received negative comments about their appearances during the recordings.

Raising these concerns, an investigation was conducted by NBC and the Screen Actors Guild in December. The investigation, as NBC announced, revealed that Gabrielle’s allegations of racism had “no bearing” on the network’s decision to sever ties with her. The results, however, highlighted “some areas where the notification processes could be improved”.

“Through the investigation process, it was revealed that no one associated with the program had made insensitive or derogatory comments about the appearance of Ms. Union, and that neither race nor sex was known. a factor contributing to the advancement or elimination of the candidates at any time, ”the press release is said to have partially.

In response, however, Gabrielle’s lawyer Bryan Freedman issued the following statement:

“When Gabrielle Union informed NBC of offensive racist behavior during the recording of America has talent, NBC did not “stand” with it in “outrage at acts of racism”. … Instead, NBC did not care enough to quickly investigate Ms. Union’s complaints or even ask HR to get involved. Instead, NBC objected to her and directed her “ indignation ” against Ms. Union for speaking out against the offensive racist conduct she experienced while working for NBC on America has talent. “

The complaint filed with the DFEH on Thursday also contains a new allegation against the president of NBC Entertainment Paul Telegdy. More specifically, that the head of the network tried to “undermine” an investigation into Gabrielle’s complaints by “putting pressure on Union to provide her true experience of racial discrimination”.

According to Fox News, the president of NBC called Gabrielle’s agents to issue “unspecified threats” and shared confidential information about the controversy with celebrities the show was looking to hire.

NBCUniversal responded to Thursday’s Gabrielle complaint by saying, “The allegation that everyone involved in this process has threatened Ms. Union is flatly false.”

“We took Ms. Union’s concerns seriously and hired an outside investigator who discovered a global culture of diversity on the show,” said the statement. “NBCUniversal remains committed to creating an inclusive and supportive work environment where people from all walks of life are treated with respect.”

Meanwhile, Gabrielle’s husband, former NBA star Dwyane Wade, visited social media on Thursday to defend his wife’s decision to file a complaint.

“You considered her a liar after trying for months to inform her of problems at the workplace and to make sure that the other colored employees who came after her would not have the same experiences”, a- he tweeted.
